1. General
This Privacy Policy describes how Praktijk voor natuurgeneeskunde Ellen Kuijer (sole proprietorship), trading as Elmotion Massages & Coaching (hereinafter the "Therapist"), governs and respects the privacy of users of the website (hereinafter the "User", plural "Users"), and what information about the User is collected. This document also describes how the Therapist collects, stores and uses data in her role as an alternative/complementary healthcare provider. If the User of the website makes use of the Therapist's services, the User is referred to as the "Client", plural "Clients".
2. Request for consent and provision of this Privacy Policy
When using the Therapist's website, this Privacy Policy is brought to the attention of every User, with a request to agree to it. Continued use of the website means that you agree to the use of cookies and this Privacy Policy.
The Therapist asks the User to read this Privacy Policy in full before using the website. If you do not agree with it, please leave the website.
3. Nature of the information retained
Now and in the future, the Therapist collects information about Users of this website. The Therapist uses the website for the purposes stated below.
3.1 When using a webshop or another way to purchase services or products
For orders placed via the website (for example online programmes, the Ixchel Integration Membership, or other digital content), personal data is retained such as name, address, age (age is checked to verify legal capacity — legitimate interest), email address and phone number.
3.2 When requesting information (for example a newsletter) or when information is shared with the User
For requesting information via the website, personal data is retained such as name, address, age (age is checked to verify legal capacity — legitimate interest), email address and phone number.
3.3 When registering or signing up for alternative care (the User becomes a Client)
This applies, for example, if you register for a massage or coaching session, a Get into your body programme, a workshop, or a training. In this case, the Therapist collects more data about a Client than about a standard User. For every Client, the Therapist is legally required to keep an extensive client record. See article 3.4 for this.
3.4 The client record
This record contains the following types of data about the Client: name, address, age (age is checked to verify legal capacity — legitimate interest), gender, email address, phone number, medical data, notes on the Client's (mental) state of health, and data on the sessions and treatments carried out by the Therapist in relation to the Client, and the frequency with which the Client receives care from the Therapist. In short, the Therapist documents, each time the Client receives care, who received which care and when. It is possible that the Therapist, with the Client's express consent, requests medical data from a fellow healthcare provider or from the Client's GP. Such data is also included in the record.
3.5 Email messages
If email messages are sent, this email and/or accompanying information from the email may be stored for the purpose that these email messages serve.
4. Purpose of retaining information
4.1 Administration
The information is used for various purposes. Retained information (retention period 7 years) as referred to in articles 3.1 and 3.3 is used to process and invoice orders and their delivery, or alternative care in accordance with the agreement, for bookkeeping purposes, and for handling any disputes. Information from article 3.3 or 3.5 may also be retained for this purpose.
4.2 Improving services
Information collected as referred to in articles 3.2, 3.3 and 3.5, and possibly 3.1, is used to improve the website and to optimise its ease of use.
4.3 Marketing
Information collected as referred to in article 3 (with the exception of article 3.4) may be used to draw Users' attention to information that may interest them, and to develop new services and programmes. This concerns information provided by the User to the Therapist during a visit to the website, or through other means.
This data may be used for marketing purposes and as anonymised statistical information.
Privacy-sensitive data, such as payment details, is treated confidentially and is not made available to third parties. Personal data is only used for commercial purposes if a User is a Client (GDPR basis: performance of an agreement and/or legitimate interest), or if unambiguous prior consent has been given in accordance with the GDPR.
4.4 The client record
The Therapist is legally required to keep a record for every Client in a dedicated client record. The data in this record is retained for a total of 20 years. The data in the record is used to provide effective care. In addition, the information may be used for:
• Financial administration — for example, to prepare an invoice or care statement.
• Anonymised discussion during peer consultation (intervisie) — the Therapist may hold peer consultation sessions with a fellow therapist and discuss the Client's case. This is done anonymously; no information that can be traced back to a person is discussed.
• Informing other healthcare providers — when the Therapist is absent and another therapist provides cover, or in the event of a referral to another therapist (only with the Client's consent).
• Other purposes — if the client record is shared for another purpose, this is done only with the Client's consent.
4.5 Information on the care invoice
The Client receives a care invoice (zorgnota) when alternative care has been provided by the Therapist. After payment by card, cash, or another payment method, this is either handed over directly, or sent later by email to the email address provided by the Client. This invoice states the following information about the Client: name, address, place of residence, date of birth, cost of the consultation, description of the type of care provided, and date of treatment. This information is for the Client's own administration and, through the Therapist's affiliation with CAT, may be submitted to the reimbursing health insurance company, if the treatment qualifies for reimbursement.
5. Changes to this Privacy Policy
In the future, the way in which information is used or deployed, and the purposes for which this happens, may change. In that case, the Therapist will state the changes in a revised Privacy Policy and publish it on the website. Users who do not agree with a revision may send their objection to the correspondence address or email address stated in article 9. The Therapist will respect and take these objections into account. If no objections are submitted, the visitor is deemed to agree to the changes upon continued use of the website.
6. Changing data or questions about privacy
Does the User or Client want to change or have deleted the information retained by the Therapist, or does the User or Client believe that the information is being used for a purpose other than the one for which it was provided? Please report this to the Therapist, by post or email as stated in article 9. The Therapist will then arrange for the data to be corrected or deleted, with the exception of information that is legally required or directly related to a concluded agreement, insofar as retaining it is necessary.
7. Security
The Therapist uses standard technologies to guarantee security as much as possible and to prevent unauthorised access as much as possible. However, this cannot be guaranteed with complete certainty. The Therapist is not liable for unauthorised use of information referred to in article 3, or for unauthorised access to the website. The Therapist advises changing passwords regularly and using a reliable and secure browser.
8. Address of the website User
Users and Clients are required to inform the Therapist of any change of address or other contact details. As long as the Therapist has not received notice of a change, the most recently known details are assumed to be correct. Any miscommunication resulting from this is at the risk and expense of the User or Client.

10. Additional information
10.1 Complaints about the way in which the User's or Client's information is handled can also be reported via the website of the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, www.autoriteitpersoonsgegevens.nl).
10.2 Does the User or Client share a photo or other image as part of the information referred to in article 3? Then this photo or image is also stored as information as referred to in article 4.
10.3 Does the Client or User also use a programme or software to share information outside of the Therapist? Then it is possible that this programme or software shares or distributes the information independently. The Therapist cannot be held responsible for the way in which this programme or software handles information in that situation.
10.4 Does the Therapist make use of the services of a third party acting as a processor of information as described in article 3 (for example a booking system, payment provider, or platform of The Ixchel System)? Then the Therapist has, or aims to, enter into a data processing agreement with that party.
11. Cookies and website disclaimer
The website of Elmotion Massages & Coaching may use cookies. At present, at least functional/session cookies are used that are needed to make the website, the booking system, and any webshop function properly; these are deleted after use, at the latest 15 days after they are created.
Does the website also use cookies for statistics (for example Google Analytics), or cookies from third parties (for example for marketing purposes)? Then this is indicated on your first visit to the website via a cookie notice, together with the option to agree or not agree to this. The most up-to-date information about which cookies are used and for what purpose can be found in the cookie notice on the website itself.
